These Terms & Conditions outline the basis on which our services are provided and govern the use of our website, application forms, communications, and childcare matching services.
By accessing our website, submitting an enquiry or application, or engaging with our services, you acknowledge and agree to these Terms & Conditions.

1. About Nurtured Roots Care

Nurtured Roots Care is a childcare matching and introduction service based in Ericeira, Portugal.
We provide thoughtful and relationship-led introductions between families and independent childcare providers, including nannies, babysitters, and family assistants. Our services are primarily offered within Ericeira, Mafra, and surrounding areas.

2. Nature of Our Services

Nurtured Roots Care operates primarily as a childcare matching and introduction service.
Unless explicitly stated otherwise in writing:

  • Nurtured Roots Care is not the direct employer of childcare providers.

  • Employment agreements are made directly between families and childcare providers.

  • Families are responsible for their own hiring decisions, employment arrangements, payroll obligations, insurance, and legal compliance where applicable.

  • Childcare providers remain independently responsible for the services they provide.

In some cases, Nurtured Roots Care may provide additional ongoing support, guidance, or placement care services following a successful introduction.

3. Eligibility

Users of our services must be at least 18 years old.
By submitting information through our website or forms, you confirm that:

  • the information provided is accurate and truthful

  • you have the legal authority to provide the information submitted

  • you are acting in good faith throughout the application and matching process

4. Childcare Provider Screening

Nurtured Roots Care aims to carry out a thoughtful vetting and screening process before introductions are made.
This process may include:

  • interviews

  • reference checks

  • identity verification

  • qualification review

  • work eligibility verification

  • supporting documentation where relevant

Where appropriate, childcare providers may also be asked to provide criminal background certificates or equivalent documentation. While we take reasonable care in our screening process, we cannot guarantee the suitability, conduct, compatibility, availability, or future actions of any individual. Families remain responsible for making their own final hiring decisions.

5. Family Responsibilities

Families agree to:

  • provide accurate and honest information

  • communicate respectfully with childcare providers and Nurtured Roots Care

  • conduct their own final assessment before hiring

  • comply with applicable employment and tax obligations where relevant

  • maintain safe and appropriate working conditions

  • communicate concerns promptly and respectfully

Families are responsible for supervising and managing childcare arrangements once employment or bookings begin.
Where families choose to engage in ongoing support services offered by Nurtured Roots Care, additional guidance, communication support, and placement care may continue throughout the arrangement in accordance with the agreed service structure. Such support does not transfer day-to-day supervision or employment responsibility to Nurtured Roots Care unless explicitly agreed otherwise in writing.

6. Childcare Provider Responsibilities

Childcare providers agree to:

  • provide accurate and truthful information

  • communicate professionally and respectfully

  • maintain appropriate standards of conduct and care

  • disclose relevant qualifications and experience honestly

  • comply with legal working requirements in Portugal where applicable

  • inform Nurtured Roots Care of significant changes that may affect placements

7. Placement Fees and Payments

Nurtured Roots Care may charge placement fees, booking fees, or ongoing support contributions depending on the nature of the service provided.
Fee structures, payment terms, and service details will be communicated separately before confirmation of services. At this time, payments relating to long-term childcare arrangements are generally made directly between families and childcare providers unless otherwise agreed in writing.
Initial consultations may be offered free of charge.

8. Replacement Policy

If a placement does not work out, Nurtured Roots Care may offer one replacement introduction within 30 days of the original placement date, where reasonably possible. Replacement support is provided at the discretion of Nurtured Roots Care and depends on factors including:

  • honesty and cooperation from all parties

  • timely communication regarding concerns

  • the circumstances surrounding the placement ending

  • availability of suitable alternative candidates

A replacement introduction does not guarantee a successful future placement. Families receiving ongoing support or network access services may be eligible for continued re-matching support, priority introductions, or adjusted replacement arrangements depending on the agreed service structure.

9. Introduction Protection

Families and childcare providers introduced through Nurtured Roots Care agree not to intentionally bypass the service in order to avoid agreed placement fees or service arrangements relating to introductions facilitated by Nurtured Roots Care. This applies specifically to introductions made directly through Nurtured Roots Care and is intended to protect the time, care, screening, and matching work involved in facilitating placements. Nothing in these Terms prevents families or childcare providers from independently seeking other childcare or employment arrangements outside of introductions facilitated by Nurtured Roots Care.
We encourage any concerns regarding placements, fees, or ongoing arrangements to be communicated openly and respectfully so that solutions can be approached constructively wherever possible.

10. Refund Policy

Unless otherwise agreed in writing, placement fees and booking fees are non-refundable. Nurtured Roots Care may review exceptional circumstances on a discretionary basis.

11. Ongoing Support Services

Where ongoing support or network access services are offered, the scope of support will be communicated separately.
These services may include:

  • ongoing communication support

  • guidance during placements

  • assistance with replacement coordination

  • continued access to the childcare network

The nature and duration of ongoing support may vary depending on the agreed service arrangement.

12. Limitation of Liability

Nurtured Roots Care aims to provide a thoughtful and professional matching service but cannot guarantee:

  • compatibility between individuals

  • successful placements

  • future conduct or actions of any party

  • uninterrupted availability of childcare providers

  • outcomes arising from independent agreements between families and childcare providers

To the fullest extent permitted by law, Nurtured Roots Care shall not be held liable for:

  • disputes between families and childcare providers

  • employment-related matters

  • damages, losses, injuries, or claims arising from childcare arrangements

  • indirect or consequential losses

Families and childcare providers remain responsible for their own decisions, agreements, supervision, and legal obligations.

13. Communication Standards

Nurtured Roots Care is built on respectful, thoughtful, and trustworthy working relationships.
Users of our services agree to communicate respectfully and honestly with:

  • Nurtured Roots Care

  • families

  • childcare providers

Harassment, abusive behaviour, discrimination, dishonesty, or inappropriate conduct may result in refusal or termination of services.

14. Privacy and Data Protection

Personal information is handled in accordance with our Privacy Policy.
By using our services or submitting forms, you acknowledge that certain personal information may be shared as reasonably necessary for the childcare matching process. For more information, please refer to our Privacy Policy.

15. Website Use

All content on this website, including branding, text, graphics, and materials, belongs to Nurtured Roots Care unless otherwise stated. Content may not be copied, reproduced, or distributed without prior written permission. We reserve the right to modify, suspend, or discontinue parts of the website or services at any time.

16. Changes to These Terms

Nurtured Roots Care may update these Terms & Conditions from time to time to reflect changes in services, operations, or legal requirements.
Updated versions will be published on this page with a revised update date.

17. Governing Law

These Terms & Conditions are governed by the laws of Portugal.
Any disputes relating to these Terms or the use of our services shall fall under the jurisdiction of the Portuguese courts where applicable.
